Terms of service

These terms are the agreement between you and Tendthread for your use of the service. Creating an account means accepting them. If you do not accept them, do not create one.
Who you are contracting with
The company behind Tendthread is being incorporated in England and Wales. Its registered name, company number and registered address will be published in this section as soon as they exist, and these terms will be given a new version when they are. In the meantime, we and Tendthread mean the operator of this service, and you means the person or business holding the account.
The service
Tendthread connects one mailbox you already own, keeps track of the leads you add to it, plans follow-ups for them, writes and sends those follow-ups from your own address on a schedule, and reads the threads it manages so that it stops when someone replies.
The service is provided free of charge at present. Paid plans will be introduced. We will give you notice before any charge applies to an account you already hold, and nothing here obliges us to keep any part of the service free.
There is no service level agreement and no uptime commitment. We may change, add to, or withdraw features, and we may stop offering the service altogether — with notice, except where circumstances make that impossible.
Tendthread is for business use. By creating an account you confirm you are acting in the course of a business rather than as a consumer. That said, nothing in these terms removes or limits any right you may have that cannot lawfully be excluded.
Your account
- Give accurate account details and keep them current.
- Keep your credentials secure. An account is for one person; do not share access to it.
- Connect only a mailbox you own or are authorised by its owner to use, and only in a way that provider allows.
- You must be at least 18 years old.
You are responsible for every message sent from your account, including the ones Tendthread drafts and sends on your behalf. They go out from your mailbox, under your name, to people you chose — and that is by design, because outreach that does not come from a real sender is not worth receiving.
Acceptable use
The acceptable use policy forms part of these terms and is incorporated into them by reference. It sets out where your leads may come from, what you must be able to say about your right to contact them, how you must identify yourself, and what you must never send. Breaching that policy breaches these terms.
Your content and your data
You own what you put into Tendthread — your leads, the context you give about what you sell, and the messages in your threads. We claim no ownership of any of it. You grant us only the permission we need to host, process and transmit that material in order to run the service for you. We do not sell it, and it is not used to train AI models.
Personal data — yours, and that of the people you contact — is handled as described in the privacy policy. Having a lawful basis for the lead data you put into Tendthread is your responsibility, not ours, and the acceptable use policy explains what that means in practice.
AI-generated output
Tendthread uses AI models to decide what to say, when to say it, and what a reply means. We do not warrant that anything a model produces is accurate, appropriate, original, or fit for any purpose. It can be wrong about your product, wrong about the recipient, or simply badly judged.
Reviewing what goes out is yours to do, and the product is built to let you: drafts are visible, plans are explained, and a lead can be paused. To the fullest extent the law allows, we are not liable for the content of messages sent from your account or for any consequence of sending them, whoever or whatever drafted them.
Deliverability and results
We do not guarantee that a message will be delivered, that it will reach an inbox rather than a spam folder, that it will be opened, or that anyone will reply. Those outcomes depend on mailbox providers, spam filters, your own sending reputation and the recipient — none of which we control.
We likewise make no promise about any commercial result: meetings booked, pipeline created or revenue earned. Nothing in our marketing is a term of this contract.
Our liability to you
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited. Those come first because, unlike the rest of this section, they are not ours to vary.
Subject to that, we are not liable to you for:
- loss of profit, revenue, business, contracts, anticipated savings, goodwill or reputation;
- loss or corruption of data;
- damage to the sending reputation of your domain or mailbox, or any blocklisting or restriction imposed on it by a mailbox provider; or
- any indirect or consequential loss.
Subject to that, our total liability to you arising out of or in connection with these terms — whether in contract, in tort including negligence, for breach of statutory duty, or otherwise — is limited in aggregate to the greater of the fees you paid us in the twelve months before the claim arose and £100.
The £100 floor is deliberate. The service is free today, so a cap set only at fees paid would be a cap of nothing, and a limit that gives you nothing is not a limit we think ought to be enforced against you.
Suspension
Tendthread may suspend or close your account immediately and without notice if spam complaints, bounce rates or abuse reports arising from your sending reach a level that threatens other customers or our standing with the mailbox providers, or if we have reasonable grounds to believe this policy has been breached. Where the problem can be put right, we will tell you what would need to change.
We may also suspend the service to protect it, its other users, or the mailbox integrations it depends on, or where we are required to by law. What a suspension means in practice, and how to challenge one, is set out in the acceptable use policy.
Ending the agreement
You may end it at any time by deleting your account. Deletion is immediate, removes your data, and cancels any follow-up still scheduled; the privacy policy sets out exactly what goes.
We may end it by giving you 30 days notice, or immediately if you materially breach these terms or the acceptable use policy. When the agreement ends, your right to use the service ends with it. The sections on your content, our liability, and governing law survive.
Changes to these terms
These terms carry a version number and an effective date, both shown at the top. When something material changes we publish a new version and tell account holders before it takes effect, so that continuing to use the service is a choice rather than an accident. Clarifications that do not alter what you are agreeing to are published as a minor version without notice.
Governing law
These terms, and any dispute or claim arising out of them or their subject matter, are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction over them.
